SAN FRANCISCO, May 5 (UPI) -- A federal appellate court has advocated the 10-year prison sentence proposed to the first California supplier of medical marijuana condemned of federal charges.
Brian Epis of Chico in northern California was taken into custody in 1997 when researchers discovered 458 marijuana plants in his home and condemned after a trial in federal court in Sacramento. Consequently, denunciators incriminated that he was planting marijuana for a benefit, in his turn Episinsisted that he had a doctor's recommendation to use marijuana as treatment for his neck and back pain. By the way this entire weed was presupposed for his own possession and probably to share with a few others with medical problems.
By the way a federal appeals quinquevirate in San Francisco denied Epis's point that he thought he was operating justifiably because California voters had adopted Proposition 215, the San Francisco Chronicle reported. A large scale marijuana activity can have an influence on interstate commerce following to the court.
The 9th U.S. Circuit Court of Appeals is expected to be asked for a rehearing by advocates. |
